Brandon Anesthesia Error Lawyer

One of the most important aspects of any surgical procedure is the administration of anesthesia, which is a drug that allows patients to avoid experiencing pain during their procedures. However, administering anesthesia is a complicated process that requires careful calculations of the type and amount of drug that is appropriate for a particular patient. Unfortunately, even minor errors during this process can have devastating consequences for patients, often resulting in permanent disability or even death, so if you or a loved one were injured as a result of an anesthesia error, please contact one of our experienced Brandon anesthesia error lawyers to learn more about your legal rights.

Common Errors and Injuries

Administering anesthesia is a complex undertaking and is not without its risks, even when administered properly. For this reason, patients who are scheduled to undergo surgery must be notified of the potential negative reactions they could experience, which could include:

  • Nausea and vomiting;
  • Post-operative pain;
  • Temporary confusion; and
  • A sore throat.

There are also, however, certain injuries that only occur when an anesthesiologist makes one of the following errors:

  • Administering the wrong dosage of anesthesia due to a lack of familiarity with medical equipment, improper training, insufficient experience, or carelessness;
  • Failing to control the rate at which anesthetic drugs enter a patient’s system, which can often be linked to equipment failure;
  • Failing to properly intubate a patient, which can result in severe damage to the teeth;
  • Administering the wrong type of anesthesia;
  • Failing to prevent an allergic reaction due to a failure to conduct tests or properly monitor the patient during the procedure;
  • Failing to manage a patient’s postoperative pain;
  • Failing to recognize complications as they develop; and
  • Failing to monitor a patient during the procedure, including his or her oxygen intake.

If you sustained an injury due to one of these types of errors, you could be entitled to compensation. Please call our office today to learn more.

Proving Negligence

In order to prove that an anesthesiologist was negligent, plaintiffs must hire an expert medical witness who will assess factors like the plaintiff’s pre-surgical risk, the surgeon’s notes, and the complication rate for the type of anesthesia used during the surgery. An expert witness will then be able to offer an opinion on whether the defendant complied with the proper standard of care.

Even if this element is fulfilled, the plaintiff will also need to prove that the error in question resulted in an injury before he or she can recover compensation for medical bills, lost wages, disability, and pain and suffering. Finally, plaintiffs will usually be barred from recovery if they do not file a claim before Florida’s two year medical malpractice statute of limitations expires, although in some cases, the deadline could be extended to four, or even seven years.
